Child Support

Child support is an issue in any child custody proceeding.  The possessory conservator, or non-custodial parent, is obligated to pay child support to the managing conservator for the support of the child.

The obligor for child support is the party paying child support.  The obligee is the party receiving child support.

A withholding order can be entered for child support to be automatically withheld from the obligor's paycheck and submitted to the State Disbursement Unit (SDU).  The SDU tracks all child support payments made, which can assist with future litigation for enforcement of a child support obligation.  The SDU then sends the child support to the obligee.

Child support is calculated using a percentage of the obligor's net monthly resources.  Net resources, for the determination of child support, is gross income less social security and federal taxes and health insurance for the child the subject of the suit.   The percentages applied to calculate child support are as follows:
Number of Other Children Obligor Has a Duty to Support Number of Children Before the Court
  1 2 3 4 5 6
  0 20% 25% 30% 35% 40% Not less than the amount for 5 children
 1 17.5% 22.5% 27.38% 32.2% 37.33%
 2 16% 20.63% 25.2% 30.33% 35.43%
 3 14.75% 19% 24% 29% 34%
 4 13.6% 18.33% 23.14% 28% 32.89%
 5 13.33% 17.86% 22.5% 27.22% 32%
 6 13.14% 17.5% 22% 26.6% 31.27%

The obligor for child support is usually the party the court orders to provide health insurance for the child. Health insurance can either be provided through the obligor's employment, or the obligor can reimburse the oblige for the actual cost of insuring the child through health insurance available through the obligee's employer.
